Is CBD Legal in Arizona?
There is some concern about the legality of CBD in the state of Arizona, which we completely understand. The state passed the Arizona Medical Marijuana Act in 2010, which made medical cannabis products legal, including CBD whether it was derived from industrial hemp or marijuana. However, in 2018, there was an Arizona Court ruling claiming that all marijuana and hemp extracts are illegal. This particular case was the <a href=”https://law.justia.com/cases/arizona/court-of-appeals-division-one-published/2018/1-ca-cr-16-0703.html”>State vs. Jones</a>. Because of that ruling, we can understand how there is some ambiguity.
Marijuana-derived CBD is explicitly illegal for recreational use. In order to use medical cannabis or marijuana-derived CBD, you must have a prescription from a licensed physician. In May of 2018, there was a bill passed in Arizona that allowed industrial hemp producers to begin operations so long as they were approved and properly licensed. Later that year, Congress passed the often-discussed Farm Bill. Due to these two legal actions, hemp-derived CBD is completely legal in Arizona. In fact, some marijuana dispensaries throughout the state even carry some CBD products. Be sure to double check that you’re allowed to be a patron at a dispensary without a card!
